Acceptance
These Terms of Use ("Terms") govern your use of LightGPX, the iOS and macOS apps and any related services (together, "the Service"), operated by Valentino Zegna ("we", "us"). By creating an account, installing the app, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
License to use
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, for your personal or internal business use, subject to these Terms and — for the iOS app — Apple's Licensed Application End User License Agreement.
You may not: redistribute the app, reverse engineer it except where expressly permitted by law, strip attribution, or use it to build a competing product.
Your account
A LightGPX account is required. You sign in with Apple or Google. You are responsible for protecting access to whichever identity provider you use. You must be at least 13 years old to create an account; if local law sets a higher digital-consent age, that age applies.
One human, one account. You may use that account on multiple devices you own.
Fees & billing
LightGPX is sold as a one-time purchase through Apple's App Store and Mac App Store. Apple handles billing, refunds, and tax under its own terms. Pricing is set per region and shown at checkout before you buy.
Cloud sync and backup are included with the app up to the storage quota in effect on your account (100 MiB at launch). If we introduce paid tiers, higher quotas, or subscriptions, we will tell you in the app before anything you do costs additional money.
Acceptable use
Do not use the Service to:
- Track another person without their consent. The app is built to record the location of the device holding it.
- Upload content that is not yours or that you do not have the right to upload.
- Attempt to break into another user's account or our infrastructure.
- Probe, scan, or stress-test the Service beyond normal use.
- Resell access to your account.
- Use the Service to violate any law.
We may suspend or terminate accounts that do any of the above.
Location & safety
LightGPX is not a navigation, safety, or emergency tool. It records where you have been, for the purpose of geotagging photographs after the fact. It does not provide routing, hazard warnings, rescue signalling, or any safety guarantee.
In the backcountry, carry a dedicated GPS, a satellite messenger (e.g. Garmin inReach, Apple Satellite SOS), a paper map, and the judgement to use them. Do not rely on this app, or any phone app, for survival.
GPS accuracy varies by hardware, environment, and sky visibility. Recorded points may be wrong by meters or, in bad conditions, much more. Treat the track as an approximation of where you were, not a legal record.
Your content, our app
You own your tracks, trips, and points. We do not claim any ownership of them. By syncing to your cloud account, you grant us a limited license to store, transmit, and process your data solely to provide the Service to you — nothing else. We do not use your location data to train models, improve recommendations, or build any product other than the one you paid for.
Your photos never leave your device through the app. Geotagging happens on your Mac; we do not receive the images.
Our intellectual property
The app, the "LightGPX" name, the pin-and-lens mark, the source code, the Supabase schema, the website, and the copy are ours. You may reference the product in reviews, blog posts, YouTube videos, and social posts — that is encouraged. You may not use the name or mark in a way that implies endorsement, affiliation, or partnership without written permission.
Availability
We aim for the Service to be continuously available. It will not always be. Backend outages, network issues, iOS bugs, and cosmic rays will cause interruptions. Your iPhone keeps recording when our servers are not reachable; the queue drains when connectivity returns.
We may change, suspend, or discontinue features with reasonable notice. If we shut down the cloud backend, we will give at least 90 days' notice and a clear path to export your data.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy. To the fullest extent allowed by applicable law, we disclaim all such warranties.
We do not warrant that the Service will be uninterrupted, error-free, secure against every attack, or that your data will never be lost. You are responsible for keeping your own backups of anything that matters — the app provides a GPX export for exactly this reason.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or lost photographs, whether in contract, tort, or any other theory. Our total liability for any claim arising from your use of the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or USD 50, whichever is greater.
Some jurisdictions do not allow certain limitations; in those places, this section applies only to the extent permitted.
Indemnity
You agree to indemnify and hold us harmless from any claim brought by a third party arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of another person.
Termination
You can stop using the Service at any time. You can delete your account inside the app (Settings → Account → Delete account); see the Privacy Policy for what that does.
We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or if continued operation of the Service for you exposes other users or us to undue risk. We will attempt to give notice where we can.
Apple App Store terms
Because you get the iOS app through Apple's App Store, the following apply:
- These Terms are between you and us, not Apple. Apple is not responsible for the app.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- We, not Apple, are responsible for addressing claims by you or any third party relating to the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, entitled to enforce them against you.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Disputes not otherwise resolved will be brought in the competent state or federal courts located in San Francisco, California. This clause does not deprive you of any mandatory consumer-protection rights under the law of your own country of residence.
Changes
We may update these Terms. If we change anything that reduces your rights or expands ours, we will update the effective date and, where we have your email, notify you. Continued use after a change means you accept the new version. If you do not, delete your account and stop using the Service.
